2018-19 SeasonOctober 31, 2018Facts:On October 14, 2018 KC Men’s Soccer player Eduardo Filho (#20) received a yellow card for knocking UAA’s Ethan Miller to the ground. UAA has requested a video review of the incident as per the ACAC Operating Code, suggesting that a red card for violent conduct should have been called on the play in question. The request was made on October 25, 2018. Ruling:UAA has provided a video clip of the incident. UAA has indicated that Mr. Miller sustained a concussion on the play and has submitted medical evidence in support. UAA also advises that at the present time, Mr. Miller has not returned to classes and that he played in no further matches after the incident in question. Article III Section 1 Rule 1.4 of the ACAC Operating Code reads as follows: 1.4. Request for Supplemental Ruling/Videotape: An athletic director may submit videotape to the ACAC Commissioner to receive an extraordinary ruling. An infraction must have been called by the game official, a serious act of misconduct have occurred, or a major injury have resulted from the incident. The request including a videotape of the incident, or additional information pertinent to the incident, must be submitted to the ACAC Office within 72 hours of the incident and a $250.00 non-refundable fee is to be paid. (Amended Oct, 2013) As indicated above, UAA’s request for a ruling was made on October 25, 2018, some 11 days after the incident in question, which is well beyond the 72 hour (3 day) deadline referenced in Rule 1.4 above. UAA has indicated that “much of the reason for the delay has been in receiving a clear video log of the incident.” That said, UAA took no steps to advise either the Commissioner or the ACAC Office that a request for a ruling would be forthcoming once they were able to solve their video issues. The wording of Rule 1.4 does not provide me with the discretion to extend the 72 hour deadline, particularly where no indication that a request for a ruling would be forthcoming was communicated until 11 days after the incident. Therefore, it is not necessary for me to examine the merits of the incident as the request for a ruling is denied based on UAA’s failure to submit the request within the required timeframe.
