Prior to the 2002-03 season, a student attended another postsecondary institution and transferred to an ACAC college. Prior to a Universal Transfer Form (UTF) being filed, the student played in 2 games in which his team won. After that the college received the UTF that indicated the student was academically ineligible according to their standards, which are somewhat higher than most ACAC institutions. The college sought clarification from the Executive Director who suggested that because of the higher standards he would be deemed academically eligible. After this ruling the student participated in 4 games, resulting in 3 wins and 1 tie. After these games were played another college appealed the Director’s ruling.
RULING:
The Director’s recommendation was overturned by the Commissioner who ruled the student academically ineligible for at least the fall semester. The college was in breach of the O.C. for not filing the UTF prior to the student’s participation in league play. The 2 wins recorded before the UTF was received were forfeited. The other games were not affected because at the time of play the player had been ruled eligible by the Executive Director. |
